From the Dean

Colleagues, Faculty, Staff and Students,

ShomakerAnother month has flown by, and I appreciate your continued service to the College of Medicine. As we prepare for the next legislative session over the coming months, I encourage you all to be mindful of our resources. I cannot emphasize enough the importance of stewardship of our finances and resources. We absolutely must work together and work wisely to maximize each program, activity and opportunity not only for our students, but for our communities as well.

We also have to work hard to diversify our revenues so as to reduce our over-dependence on state dollars. This will require creativity and entrepreneurship from people across our organization. I encourage those of you that have ideas on how we can save money or increase revenue to share them with me by email (shomaker@medicine.tamhsc.edu), phone (979-436-0205) or by stopping by my office on the third floor of the Health Professions Education Building on State Highway 47 in Bryan. If my door is open, I am available. I also want to commit to you that I will be very transparent about the fiscal challenges we are facing and how we intend to address them. This is in keeping with my philosophy of leadership and is consistent with my belief that it is better to share more information with those who will be impacted by the challenges we face as an organization.

I’d like to take a moment to speak about the importance of public service, especially in medicine. Recently, I’ve had an essay selected by Academic Medicine, the journal of the AAMC, as one of the essays of the year. As such, I’ll be making a couple of national presentations, including a presentation at the AAMC national meeting in November, on “The Medical Marshall Plan: Rebuilding Public Trust in American Medicine,” and I will share that presentation with faculty, staff and students.

Much has happened in the past month, and as you read this newsletter, take a moment to thank or congratulate your colleagues and students for their hard work. Another successful Summer Research Program was hosted by the Office of Research. From first- to fourth-year, our students are organizing and volunteering at more health fairs in our campus communities. Our signature community outreach program, Mini-Medical School, is about to kick-off in Round Rock for the first time; and for the third year, one of our faculty is reaching out to young girls interested in science. All this and more is happening, and I thank you in advance for your continued hard work.

Please note the upcoming events, and I encourage you to keep up the great work that you are doing for your departments and for the college.

Sincerely,

T. Sam Shomaker, M.D., J.D.

TECHNOTES FROM DR. JOE JILKA

Question: Does a poster at a scientific meeting count as “public disclosure” for purposes of patent law?

Answer: To the question as to whether a poster constitutes public disclosure — the answer is perhaps, under circumstances such as this if you have a poster or several posters that the public can readily access and see, the courts might regard that as a public disclosure. That would start the one-year time clock to file a US patent application. The real question about whether the disclosure at the meeting is a problem is whether it is an enabling disclosure (a disclosure that is sufficient for another to reproduce the invention).

For example, if a specific nucleotide sequence was essential in a method to identify a particular type of cancer and the disclosure was based around the screening method and data (but excluded the particular probe sequence) this would not be a publication of the invention as no one could replicate the invention without knowledge of the nucleotide sequence. Thus, there are ways of publishing data on posters and in lectures that do not disclose the invention.

Keep in mind that the grace period to file a patent application after disclosure of an invention is only available in very few countries (not at all in Europe and most of Asia). Therefore, if the invention is of high value and Europe and Asia are commercial targets for the invention, it is essential to file a disclosure with the Texas A&M Office of Commercialization (OTC) before disclosure as the grace period in the USA (and Australia) will not save the patent elsewhere. According to Europe and Asian patent laws, once the invention is disclosed, all patent rights to the invention are lost. The OTC will evaluate the disclosure and take the appropriate steps to protect the intellectual property if needed.

Another option would be to fill out an invention disclosure form and submit a disclosure to the OTC. Invention disclosure forms can be found on the OTC website. Generally the PI would explain what the problem is, how the prior art has failed to solve the problem, and how he or she will solve the problem. The OTC may decide to file a provisional patent application with the patent office before the session in order to establish a priority date.

Latest News from the Center of Excellence for Research on Returning War Veterans

Dr. Marc Kruse received the NIAAA/NIDA Early Career Travel Award, 118th Annual Scientific Meeting of the American Psychological Association.

Dr. Sandra Morissette was awarded as the Central Texas Veterans Health Care System Outstanding Woman of the Year by the Federal Women’s Program celebrating Women’s Equality Day on August 26, 2010. The Federal Women’s Program Committee named four winners as Central Texas’ Outstanding Women of the Year and recognized all of the nominees during the Program which was held at the Temple Campus.

Dr. Sandra Morissette receives token of appreciation for improving the lives of veterans! A veteran and his three-year-old son came to the VISN 17 Center of Excellence for Research on Returning War Veterans to express their appreciation for the care the veteran has received. They presented to Dr. Morissette a small wall hanging saying, “Land of the Free, Because of the Brave.” The son said with a big smile, “My Daddy is better now.” The veteran stated that he is thankful for services he has received at CTVHCS and “whenever I fill out your research measures, I can see how much I have improved!” He was grateful for the research we are doing because he knew it was making a difference in his life and the lives of other veterans! This is a great example of how clinical and research services can work together to make a difference for our veterans.
